Then, Sam is joined by two attorneys from Levin Papantonio law firm, first talking with Jeff Gaddy about his ongoing mass tort case against major social media companies including Meta, Snap, Google, and ByteDance (TikTok), and their platforms’ exploitation of minors via overwhelming exposure to addictive and harmful content. Gaddy walks through these corporations’ responsibility for the design and development of their platforms, touching on the protections from liability for true third-party content that Section 230 offers and the exceptions to these protections when it comes to these corporations’ production of their own (even if derivative) content and to how said design and development curates and highlights the content users engage with. After running through various other ongoing cases against these companies, Jeff and Sam unpack the developing role of legislative challenges to these practices and the importance of civil law in pushing these issues into the open, wrapping up the interview by briefly touching on the major revelations in discovery and what the “damages” of this exploitation look like. Cameron Stephenson is the next attorney to join, diving into the recent proliferation of GLP-1RA drugs, from the FDA’s approval of Ozempic as a diabetes medication in 2017, through the now sixth variation between Novo Nordisk and Eli Lilly that focuses more on medical (or even cosmetic) weight loss, and the pharmaceutical industry’s complete failure to properly warn some millions and millions of patients about serious risks and side effects associated with the drug class – namely gastroparesis. After expanding on the particular role off-label marketing of cosmetic uses played in contributing to the pervasion of GLP-1RAs – despite the relatively minor financial penalties associated with it – Stephenson wraps up the interview by unpacking the impact of this pharmaceutical malpractice, and the importance of civil law in pushing for genuine change. Sam and Emma also cover Kari Lake and Ruben Gallego’s clash over the exploitations of crisis capitalism, Harris’ complete failure to highlight any of the popular elements of her platform, and the inspiration Donald Trump is finding in the extreme inequality of the Gilded Age.
