Sam hosts Slate’s Mark Joseph Stern (@mjs_DC) to discuss Trump v. New York, which argues whether or not all people should be counted in the census. And then Rachel Cohen (@rmc031) and Marcia Brown (@Marcia_Brown9) from the American Prospect & the Intercept join to discuss their piece “How to Counteract the Court,” on how Congress can counteract the courts through statuary interpretation. Sam and Mark discuss how the Supreme Court expedited the Trump administration’s case to discount non-citizen residents in the 2020 census and how the case made it to the Supreme Court in the first place. Then Marcia Brown and Rachel Cohen of the American Prospect and the Intercept explain why the progressive left should organize around statutory rulings which are distinct from a constitutional ruling and would allow a workaround the 6-3 conservative Supreme Court.
